GARCAM STORE OPERATOR
1. IDENTITY AND ADDRESS OF THE RESPONSIBLE PARTY.
This Privacy Notice establishes the provisions under which GARCAM Store Operator S.A. de C.V. (hereinafter "GARCAM Stores"), located at Vialidad Sacramento 10707, Nombre de Dios, CP 31150, Chihuahua, Chih., Mexico, and authorized to receive notifications, will manage and safeguard the personal data of the Holder responsibly.
2. CONSENT OF THE HOLDER.
To comply with the provisions of the Federal Law on Protection of Personal Data Held by Private Parties (LFPDP) and other current regulations, the Holder declares that they have received, read, understood, and accepted the terms set forth in this Notice by the Responsible Party. In the event that the data includes financial or asset information, the Holder, by signing the corresponding contract, whether in physical or electronic format, expresses their explicit consent for the processing of their data by GARCAM Stores or their Managers, including the carrying out of transfers and/or transmissions of personal data in accordance with the stipulations in section 6 of this Notice..
3. PERSONAL DATA WE COLLECT.
GARCAM Stores is authorized to collect personal data from the Holder through direct and/or personal delivery via any contact method between the Holder and the Responsible Party or their Managers. Additionally, it may obtain personal data indirectly through publicly accessible sources and other available market sources..
4. PURPOSE OF PERSONAL DATA.
4.1 PRIMARY PURPOSES. GARCAM Stores will handle the personal data of the Holder to carry out various activities and management associated with fulfilling obligations arising from any commercial or legal relationship established within the framework of its services. This includes tasks related to invoicing, collection management, granting credits, customer service, technical support, warranties, management of additional services, as well as communication with customers, sales force, and distributors.
Additionally, the data will be used to provide, renew, retain, activate, modify, cancel, or return services requested by the Holder. This data will also be employed for tasks related to access control and the security of material and human resources within GARCAM Stores' facilities.
4.2 FINALIDADES SECUNDARIAS. GARCAM Stores will process personal data for various additional purposes, such as sending notifications of offers, promotional messages, and marketing communications about products and services, either from GARCAM or its business partners. Furthermore, the data will be used to conduct surveys, statistics, market studies, track consumption habits, interests, and behaviors, as well as benefits programs and participation in social networks, chats, forums, events, and raffles.
These activities are aimed at promoting, maintaining, improving, and evaluating your products and services. If you do not express your opposition within five business days after your data is collected, it will be understood that you grant your consent for such additional purposes.
5. VIDEO SURVEILLANCE AND PHOTOGRAPHY.
In the facilities of GARCAM Stores, video recording and, occasionally, photography of every person who visits is carried out. These images captured by our security cameras have the primary purpose of safeguarding the safety of visitors and the remote monitoring of the premises, allowing for the identification and mitigation of any risk situations in real time.
The essential purpose of this closed-circuit television system is to protect both material and human resources within our corporate facilities. Additionally, photographs are specifically used for access control.
It is important to note that the resulting video recordings and photographs are stored in our facilities for a period of 25 to 35 days. This measure is part of our security and data protection protocols.
6. TRANSFERS AND/OR TRANSMISSIONS OF DATA.
In fulfilling its legal and commercial responsibilities, GARCAM Stores finds it necessary to share the personal data of the Holder. To this end, it establishes commercial agreements, both national and international, with various entities. These data recipients are legally obligated, through relevant contracts, to respect the confidentiality of the information provided and to comply with the terms outlined in this Privacy Notice.
Additionally, GARCAM Stores or its Managers may share the collected data with other companies within the same corporate group, both national and international, that operate under the same processes and internal policies. This is done for the same purposes described in this Notice.
It is important to note that GARCAM Stores does not require the Holder's consent to make data transfers, whether national or international, in the cases stipulated in Article 37 of the Mexican Federal Law on Protection of Personal Data Held by Private Parties (LFPDP), or in any other exceptional case provided for by applicable legislation.
7. LIMITATION OF USE AND DISCLOSURE OF INFORMATION.
The Responsible Party and/or its Managers will retain the personal data of the Holder for as long as necessary to manage their requests for information, products, and/or services, as well as to maintain accounting, financial, and audit records, in strict adherence to the Federal Law on Protection of Personal Data (LFPDP) and current commercial, tax, and administrative regulations.
Adequate administrative, technical, and physical security measures are applied to safeguard the collected data, mitigating risks such as damage, loss, alterations, unauthorized access, or improper processing, as established by legislation. However, GARCAM Stores cannot ensure that unauthorized third parties will not access the systems of the Holders or the Responsible Party, thereby exempting the company from liability for any potential damages resulting from such unauthorized access.
You or your legal representative may restrict the use or disclosure of your personal data by requesting it through the appropriate channels. If successful, your information will be included in GARCAM Stores' exclusion list, and you will stop receiving information about advertising or marketing campaigns..
Additionally, you have the right to register with the Public Registry to Avoid Advertising (REPEP) of PROFECO at http://repep.profeco.gob.mx. If you believe that GARCAM Stores is violating your personal data protection rights, you can contact the National Institute for Transparency, Access to Information, and Protection of Personal Data (INAI).

RESPONSIBILITY.- 2CAP does not assume responsibility for purchases made with credit cards without the prior authorization of the cardholder or in cases of theft. It is presumed that the person making the purchase is duly authorized to carry out the transaction, making it irrefutable.
INVOICING.- Invoices are issued only during the same month of the transaction, and any request for re-invoicing is also processed only within that same period.
Receipt of Packages at the Customer's Address.- Understanding that the merchandise is shipped according to the customer's request and is subject to the invoice generated to fulfill the agreed order, it is important to emphasize that 2CAP does not assume responsibility for damages that may occur during transport to the end consumer, which may affect the quantity or quality of the items sent. Therefore, we kindly ask that if any alterations to the packaging, breakages in the warranty seal, or damage to the box are detected, the customer should NOT ACCEPT THE PACKAGE. It is necessary to make a note on the delivery slip indicating the observed damages to the package and return the merchandise to our address to proceed with the corresponding investigation request with the courier service.
